TERMS OF SALE
ASKY
Last updated: 15 October 2026
1. SELLER AND SCOPE
This store is operated by Artur Voznickij, trading as ASKY, in the Netherlands. Contact: askyprod@gmail.com. Additional business and contact details are provided on the Seller & Contact page.
These Terms of Sale govern purchases of digital beat licenses and the files supplied with them. No physical products are delivered.
The license agreement selected for each beat determines the permitted musical uses, included files, duration, usage limits, credit requirements and any agreed royalty obligations. These Terms govern the purchase and delivery process. Neither document limits mandatory consumer rights.
2. PRODUCTS AND LICENSE RIGHTS
Before purchasing, review the beat description, audio preview, included file formats and selected license agreement.
Purchasing a license gives you permission to use the beat within that agreement. It does not transfer ownership of the underlying beat or its copyright unless a separate written agreement expressly provides otherwise.
MP3, WAV and Trackout licenses are non-exclusive unless expressly stated otherwise. Other artists may license the same beat.
An Exclusive license stops future licensing by ASKY as specified in that agreement. Previously granted licenses remain valid under their original terms. Exclusive licensing does not itself transfer copyright.
Songwriting, publishing, collaborator shares and recording-income royalties are governed by the applicable license and any additional agreement accepted by the parties. These Terms do not introduce additional royalty percentages.
3. PRICES AND PAYMENT
The applicable currency and total payable are displayed before payment. Prices displayed to consumers include applicable VAT. Any additional mandatory charges must be disclosed before you place your order.
Payments are processed through Stripe using the methods available at checkout. You must provide accurate purchasing information and be authorised to use the selected payment method.
Submitting an order creates an obligation to pay. The contract is formed when payment is confirmed and ASKY accepts the order by sending an order confirmation or providing the purchased downloads, whichever occurs first.
A failed or cancelled payment does not grant a license. If payment is taken but we cannot fulfil the order, we will inform you and refund the affected purchase.
Changes to prices or license terms do not alter an order already accepted.
4. DIGITAL DELIVERY
Purchased files and the applicable license agreement are supplied electronically, without undue delay after payment confirmation, unless a different delivery time was agreed before purchase.
Access is provided through the order page and/or the email address supplied at checkout. A customer account is not required.
Download access may use expiring links for security. Link expiry does not shorten the purchased license. If access expires or a link fails, contact askyprod@gmail.com with your order details so we can verify the purchase and restore access where you remain entitled to it.
Check your email address before ordering and keep backup copies of delivered files and agreements. This does not affect our legal delivery or conformity obligations.
5. FILE FORMATS AND TECHNICAL REQUIREMENTS
Only the files identified in the selected license are included. Previews may contain producer tags that are absent from the purchased files where specified.
You need an internet connection, sufficient storage and software capable of opening the listed formats. ZIP archives require extraction software. Compatibility restrictions known to ASKY will be disclosed before purchase.
If a file is missing, corrupted, incorrect or otherwise does not match the agreed description, contact us for assistance.
6. CONSUMER WITHDRAWAL AND IMMEDIATE DELIVERY
If you purchase as a consumer and a statutory withdrawal right applies, you may withdraw within 14 days after the contract is concluded, without giving a reason.
For immediate delivery of digital content, we will ask for your express consent to begin supply during that period and your acknowledgement that you lose the withdrawal right when supply begins. Your consent and acknowledgement will be confirmed in a form you can retain, such as email.
Accepting these Terms alone does not constitute that consent. The withdrawal right is lost only when the applicable legal requirements are satisfied.
Where you retain a withdrawal right, you may exercise it by sending a clear statement to askyprod@gmail.com before the deadline. Identify yourself and the order concerned. You may use the optional form below, but it is not compulsory.
Where withdrawal is valid, we will reimburse the relevant payments within 14 days of receiving your notice, using the original payment method unless otherwise agreed, without reimbursement fees.
Loss of the withdrawal right does not remove your rights concerning defective, misdescribed or undelivered digital content.
7. PROBLEMS, COMPLAINTS AND REFUNDS
Contact askyprod@gmail.com with your order number and a description of the problem. We aim to respond within five business days.
We will supply digital content that meets the contract and applicable legal requirements. Where it does not, you may be entitled to correction, replacement, a price reduction or termination and reimbursement, depending on the circumstances and applicable law.
A change of mind does not create an additional contractual refund right once the statutory withdrawal right has validly ended. Any voluntary exception must be agreed by ASKY.
If a contract is validly cancelled or terminated, use of the affected beat must cease to the extent required by law and the applicable license.
8. USE AND LICENSE LIMITS
Use of a purchased beat must comply with its license. The agreement determines restrictions on redistribution, resale, sublicensing, automated copyright-claiming systems and use of the underlying files.
Contact us before exceeding a license’s usage limits. Additional rights, upgrades or royalty arrangements require an express agreement; exceeding a limit does not automatically purchase additional permission.
Your own recordings, lyrics and other additions must not infringe third-party rights. Any product-specific clearance requirements must be disclosed before purchase. This does not exclude ASKY’s responsibility for supplying the rights promised.
9. PERSONAL DATA
Personal data is handled as described in the Privacy Policy and applicable data-protection law. Order information is used for purposes including payment, delivery, support, fraud prevention and legal recordkeeping.
10. APPLICABLE LAW AND CHANGES
Dutch law governs these Terms. Consumers retain any mandatory protections applicable in their country of habitual residence.
Disputes may be brought before the courts competent under applicable law. Consumers are not required to give up legally protected access to courts in their own country.
The version accepted when you ordered applies to that purchase. Later updates apply to future orders and do not retrospectively reduce purchased rights.
If a provision is unenforceable, the remaining provisions continue to apply insofar as legally possible.
